Wedding Photo Share is a web-based platform that allows wedding couples to create a shared photo gallery where guests can upload and view photos from the wedding event. Our service includes:

• Photo moderation tools for couples
• Offline-capable Progressive Web App (PWA)
• Photo download capabilities (individual and bulk ZIP)
• Multi-language support

4. User Accounts and Responsibilities

4.1 Couples (Account Holders)

When you purchase and create a wedding on our platform, you agree to:

• Provide accurate information about yourself and your wedding
• Keep your admin PIN confidential and secure
• Be responsible for all activity that occurs under your wedding account
• Moderate content appropriately and remove any inappropriate photos
• Obtain necessary consent from guests regarding photo sharing
• Use the service in compliance with applicable laws

4.2 Wedding Guests

When you access a wedding gallery and upload photos, you agree to:

• Only upload photos you have the right to share
• Not upload inappropriate, offensive, or illegal content
• Respect the privacy of others in your photos
• Use the service respectfully and not disrupt others' experience

5. Acceptable Use Policy

You agree NOT to use our service to:

• Upload, share, or distribute any illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
• Upload content that infringes on any third party's intellectual property rights
• Upload photos of minors without parental consent
• Share content depicting violence, nudity, or explicit material
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to other users' accounts or data
• Use automated systems or bots to access the service
• Interfere with or disrupt the service or servers
• Use the service for any commercial purpose other than its intended use

We reserve the right to remove any content and suspend or terminate accounts that violate these terms.

6. Intellectual Property Rights

6.1 Your Content

You retain all ownership rights to the photos and content you upload. By uploading content, you grant us a limited, non-exclusive license to store, display, and transmit that content solely for the purpose of providing our service to you and other authorized users of your wedding gallery.

6.2 Our Service

The Wedding Photo Share application, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our service without our written permission.

7. Payment and Pricing

7.1 Pricing

Our service is offered as a one-time purchase per wedding event. Current pricing is displayed on our website at the time of purchase. Prices may change, but any changes will not affect purchases already made.

7.2 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your full credit card details.

7.3 Refund Policy

We offer refunds within 14 days of purchase if you have not yet used the service (created a wedding and shared it with guests). Once photos have been uploaded to your wedding gallery, refunds are at our discretion. To request a refund, please contact us with your order details.

8. Service Availability

We strive to provide a reliable service, but we do not guarantee uninterrupted availability. The service may be temporarily unavailable due to:

• Scheduled maintenance (we will try to provide advance notice)
• Technical issues beyond our control
• Force majeure events

Our service includes offline functionality that allows guests to continue taking photos even when internet connectivity is unavailable. Photos will be uploaded automatically when connectivity is restored.

9. Data and Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with the General Data Protection Regulation (GDPR) and other applicable EU data protection laws.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our service is provided "as is" without warranties of any kind, either express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not responsible for the content uploaded by users
• We are not liable for any loss of data, photos, or content
• Our total liability shall not exceed the amount you paid for the service

Important: We strongly recommend that couples maintain their own backups of important photos and not rely solely on our service for preserving memories.

11. Indemnification

You agree to indemnify, defend, and hold harmless Wedding Photo Share, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the service at any time, with or without cause, with or without notice. Reasons for termination may include:

• Violation of these Terms
• Uploading prohibited content
• Fraudulent activity
• Extended periods of inactivity

Upon termination, your right to use the service ceases immediately. We may, at our discretion, provide you with an opportunity to download your photos before deletion.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of the country where we are established.

Any disputes arising from these Terms or your use of the service shall be resolved through:

1. Good faith negotiation between the parties
2. Mediation, if negotiation fails
3. Binding arbitration or court proceedings, as a last resort

For EU consumers: Nothing in these Terms affects your statutory rights under applicable consumer protection laws. You may bring legal proceedings in your country of residence.
